Man accused of assaulting officer

— A man arrested for assaulting a police officer appeared in court yesterday.

Eric Delmar Rubalcava, 34, of Sunnyside was arrested Friday on charges of assaulting an officer and resisting arrest, court documents show.

He was allegedly armed with a PVC pipe when deputies arrived at his home at 1814 Penn Ave. in response to a reported domestic disturbance.

Court records show Sunnyside police officer Anthony Russell ordered Rubalcava to drop the pipe “… and show him his hands.”

Rubalcava refused to do so, stood up and “… took an aggressive posture,” according to court records.

He charged Russell and punched him, records show.

The officer attempted to subdue Rubalcava, who resisted arrest and attempted to punch Russell three more times, records state.

Russell, another Sunnyside police officer and the Yakima County Sheriff’s deputy filing the probable cause documents forced Rubalcava to the ground before placing him in handcuffs and arresting him, documents show.
